●モーツァルトの頭蓋骨

　モーツァルトの頭蓋骨をみたことがある。ザルツブルクのモーツァルト・ハウスで、モーツァルトが使っていた少し小振りのピアノが置かれている部屋の隣の棚に収めてあったと思う。源頼朝公の幼き頃の頭蓋骨(笑)のような小さくできれいに磨かれた頭蓋だった。モーツァルトは骨までかわいいなとその時思ったものである。

　この骨は聖マルクス墓地の共同墓地から墓掘人が発見したといういわくつきのものだが、映画『アマデウス』にも描かれていたように、ほとんど委棄した状態で「埋葬」されたモーツァルトの骨がどうして識別できたか、眉唾なところは多い。

　しかし十九世紀の前半頃から、有名人の頭蓋骨に熱狂的な関心をもつ人々が登場した。デカルトが一六六六年に亡くなった際に、遺骸を輸送する途中で頭蓋骨を盗まれ、それが一九世紀になって忽然と登場する。そしてキュヴィエは国立自然史博物館の解剖学コレクションにこれを収録している。

　この時代には、人間の頭蓋骨の形と脳髄の重さ、さまざまな部分の発達度が、その人間の精神の発達度や特色を示しているという考え方が発展してきた。これは啓蒙の時代の特色の一つである唯物論がその論理的な帰結にまでたどりついたということなのだろうか。
そのもっとも有名な理論は骨相学であり、ガルが特にこの分野で有名であった。

　フランツ・ガル（一七五八−一八二八）は、脳には色、言語、哲学、名誉、盗み、殺人などのさまざまな精神活動の場が局在しているという脳機能局在論を主張し、さらに脳のさまざまな器官の発達が頭蓋の形成に影響し、頭蓋骨を外部から触れば、その人の性格や素質を判断することができると主張した。

　この特異な理論に、ヘーゲルは『精神現象学』で注目し、長々と記述している。ヘーゲルの『精神現象学』は、精神がさまざまな道程を経て絶対知にまで到達する過程を記述するものであるが、その節目節目において、ヘーゲルは精神が物になるという契機が必要だと考えた。

　そして意識が自己意識を経由して理性に到達した段階で、理性は現実的なものであるためには、一つの物とならなければならないはずであると考える。この段階で、頭蓋の形にその人間の精神の在り方をみようとする頭蓋論が生まれるととヘーゲルは考える。当然ながら頭蓋の形に精神の内実をみようとするこの頭蓋論は「諸規定の没概念的で恣意的な予定調和」(Pheno,245)にすぎない。

　しかしヘーゲルがこれほどのスペースをかけて頭蓋論を検討し、精神現象学における身体論のいわば結論を、精神が物になるというヘーゲルにとって重要なテーマの最後の段階に費やしているのは、当時のガルを初めとする新しい法学理論の抬頭と切り離すことはできないはずである。ヘーゲルが自然哲学で動物精気の理論を排除することができなかったように、精神の現象学では人相術と頭蓋論を切り離すことができなかったのである。

　ガルのような骨相学自体は簡単に否定されたものの、脳の機能の局在論は、ブロッカとヴェルニッケの言語中枢の発見以来、簡単には否定できない議論となっており、言語が脳の一部の機能であるとすれば、精神が物となるという事態が、医学的な裏付けをえることになる。

　ガルの議論には、ゲーテやエスキロールも関心を抱き、一八世紀にはイギリスとアメリカで大流行する。一八世紀の動物精気の理論を思わせるような影響力を発揮したらしく、ブロンテ姉妹もその小説で、骨相学的な描写をしているほどである。

　ガル自身はさらにこの医学的な「発見」を、精神異常者と犯罪者によって確証しようと努力した。このためガルは犯罪者の頭蓋骨を収集し、その突起の状態によって、犯罪を犯しやすい性向の人物を特定しようとした。このガルの理論は一般受けしたらしく、一九世紀のヨーロッパでは頭蓋骨の収集と、脳の計量が流行になるほどであり、多くの学者が研究のために死後の自分の脳を提供しているほどであった。この風潮において、この理論を一つの体系にまとめあげたのが、イタリアのロンブローゾであり、ここに犯罪人類学が誕生する。

　この犯罪人類学の理論の一つの重要な傾向としては、犯罪者である兆候は、人間の身体にある種の刻印として示されると考える見方がある。人間の身体を測定することで、犯罪者となる素質が強いかどうかが示されるのである。フランスのベルティオンは人間の身体を計測することで、当時困難であった犯罪者の同定の手段を提供した。ベルティオンの家系は犯罪人類学と深い結びつきがあるが、司法における人間のアイデンティティの特定がこうした身体的な特徴の計測によって可能となっていった歴史は、非常に示唆的である。

　この犯罪人類学では、犯罪者はその体質のため犯罪を犯すという「生来性犯罪者」の理論にまで発展する。すでにガルも犯罪はその行為の重さによってではなく、犯罪者の体質によって決めるべきだと考えていた。いわば人間の行為は道徳的な責任を負う主体としてではなく、脳という生理学的な要素によって決定される傾向があると考えるのである。そして脳は死後にしか調べることができないとしても、脳のいれものである頭蓋は、すぐに測定でき、これがその人間の精神的な特性の重要な指標となると考えられた。

　これが古典的な刑法理論の大きな転換をもたらすことになる。カントやヘーゲルの刑法理論では、基本的に罰せられるのは主体ではなく、行為であり、犯罪を犯した主体は、その責任を認めて、自分の罪と罰を引き受ける。ここでは処罰されるのは道徳的な主体であり、その主体は自らの責任を引き受けて、罰を受ける。しかし遺伝的な素質や体質のもとで犯罪者が生まれながらに決まっているのだとすると、処罰の対象は行為ではなく、犯罪的な素質をもつ主体自体に向けられることになる。

　この主体はある行為の責任ではなく、その主体が存在するという事実そのものの責任を問われるのである。犯罪を行為ではなく、存在論として考察する場合には、犯罪者という存在を社会から抹殺あるいは隔離する以外に、犯罪を防ぐ手段はなくなる。たとえばナチスの社会では、ユダヤ人だけではなく、アーリア人の血の純潔を汚す可能性のある精神障害者、肺病や心臓病の患者、同性愛者、そしてその親族まで、一掃する計画を立てていたらしい。

　もちろんこうした純粋な人種の保護という迷妄を信じるひとはいまはいないだろうし、ひところアメリカと北欧で盛んだった優生学は最近はすっかり下火のようにみえる。しかしぼくは現代の社会においては、もっとソフトな形で、優生学的な目標が実行されているような印象をうける。

　たとえば現在のフランスでは、出産前の遺伝子検査がさかんに推奨され、公的な保険で胎児のダウン症候群の診断が行われているという(Le monde 1999-03-13)。胎児に異常があることを知らされた両親は、子供を産むことに強い不安を感じるだろう。現代の社会においては、選別するのは国家ではなく、当事者に委ねられる。それだけに選別は個人化され、強制のない強制のような形で実行されることになる。ぼくにはこのソフトで治癒的な社会が、ときに怖くみえてくることがある。

このポリロゴスにはいくつものMLがあります。
フーコー、アレント、ドイツ思想、日本思想、ルーマンなどです。この雑誌には

しかしフーコーの点字版がないのは、なんとも残念!
ところで先日出版社の筑摩書房から問い合わせがあってわかったのですけど、
ぼくの著書『フーコー入門』(ちくま新書)の点字版の作成が、あとがきまで進んでいるそうです。
どのようなシステムで配布されるのかは存じませんが、点字版で読んでいただけるように
なるのかもしれません。点字版を作成される方のご苦労にも頭が下がります。
